Waste Disposal Kingston upon Thames Service Terms and Conditions

These Terms and Conditions apply to the provision of waste disposal and waste collection services in and around Kingston upon Thames. By placing a booking, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and the service provider.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means the waste disposal, waste collection, removal, loading, transportation and related services provided to you.

Customer, you or your means the individual, business, organisation or other entity requesting and receiving the Service.

We, us or our means the waste disposal service provider operating in Kingston upon Thames under whose name the booking is confirmed.

Waste means any materials, goods, debris, rubbish, refuse, junk or items presented by you for collection and disposal, subject to applicable waste regulations.

Contract means the agreement between you and us for the provision of the Service, incorporating these Terms and Conditions and any booking confirmation issued to you.

2. Scope of Service

2.1 We provide waste disposal and waste collection services within Kingston upon Thames and surrounding areas, including but not limited to domestic, commercial, office, garden and general bulky waste collections.

2.2 The specific details of the Service, such as the type and approximate volume of waste, access requirements, date, time window and location of collection, will be agreed at the time of booking and confirmed in our booking confirmation.

2.3 We reserve the right to decline any waste that we reasonably believe to be prohibited, hazardous, misdescribed or outside the scope of the Service agreed at the time of booking.

3. Booking Process

3.1 You may request a booking by telephone, email or through an online enquiry or booking system where available. All bookings are subject to availability and our acceptance.

3.2 When making a booking, you must provide accurate and complete information about:

a. The collection address in Kingston upon Thames or the surrounding service area.

b. The nature, type and approximate quantity or volume of the waste.

c. Any access restrictions such as parking limitations, time restrictions or height or width constraints.

d. Any items that may be hazardous, regulated or require special handling.

3.3 Based on the information you provide, we may provide an estimated price and available time window. The estimated price may be subject to adjustment if the actual waste volume, weight or nature differs from your description.

3.4 Your booking is confirmed only when we issue a booking confirmation outlining the key details of the Service, including the estimated price or pricing structure, and the agreed collection date or time window.

3.5 You are responsible for checking that the booking confirmation is accurate. If you believe any details are incorrect, you must inform us as soon as possible and in any event before the Service is carried out.

4. Access and Customer Obligations

4.1 You must ensure that our staff and vehicles have safe and reasonable access to the collection point at the agreed time.

4.2 You must obtain any necessary permissions for parking, entry to premises, use of lifts or loading bays, or any other access arrangements that may be required to complete the Service.

4.3 If access is restricted, delayed or prevented due to circumstances within your control, we may at our discretion:

a. Charge a waiting fee.

b. Charge a failed collection fee if the Service cannot be completed.

c. Rebook the Service for a later time or date, subject to availability and additional charges.

4.4 You must ensure that the waste is clearly separated from items you wish to keep, and that we are given clear instructions as to which items are to be removed.

4.5 You must not include any hazardous or prohibited materials in the waste unless we have expressly agreed in writing to handle such materials, and you have complied with any special conditions or charges relating to their collection and disposal.

5. Pricing and Payment

5.1 The price of the Service will be based on factors such as the type and volume of waste, weight, access conditions, required labour and disposal costs. We may use load-based, volume-based or item-based pricing, which will be explained to you at the time of booking.

5.2 Any estimated price provided before the Service is carried out is based on the information you provide. If the actual volume, weight, type of waste or access conditions differ from those described, we may adjust the price accordingly. Our team will confirm any change in price before proceeding wherever reasonably practicable.

5.3 Unless otherwise agreed, payment is due on completion of the Service. We may accept payment by cash, card or other methods that we notify to you in advance.

5.4 For business customers, we may agree alternative payment terms, such as invoicing with a specified payment period. Where invoicing is agreed, payment will be due within the time stated on the invoice. If no period is stated, payment will be due within 14 days of the invoice date.

5.5 If you fail to make payment when due, we may charge interest on the overdue amount at the statutory rate applicable to business-to-business or business-to-consumer debts, together with any reasonable costs incurred in recovering the debt.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by contacting us directly. Any cancellation or amendment is only effective when we confirm it has been received.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless we have incurred non-refundable costs on your behalf.

6.3 If you cancel within 24 hours of the scheduled collection time, we reserve the right to charge a reasonable cancellation fee to cover our costs and any lost opportunities to undertake other work.

6.4 If you are not present at the collection address at the agreed time and we are unable to complete the Service, or if we are denied access for reasons within your control, this may be treated as a short-notice cancellation and a failed collection or cancellation fee may apply.

6.5 We may cancel or reschedule the Service at any time if:

a. We are unable to provide the Service due to factors beyond our reasonable control, including but not limited to severe weather, traffic disruption, vehicle breakdown or staff illness.

b. We reasonably believe that it would be unsafe to perform the Service.

c. You are in breach of these Terms and Conditions.

6.6 In the event that we cancel the Service, we will, where possible, offer an alternative date or time. If we are unable to provide the Service, any prepayments made by you for that Service will be refunded.

7. Waste Types and Regulations

7.1 We operate in accordance with applicable UK waste management legislation, including regulations governing the collection, transport and disposal of controlled waste.

7.2 Waste collected from your premises will be taken to licensed facilities for reuse, recycling, recovery or disposal, in line with regulatory requirements and our environmental obligations.

7.3 You are responsible for informing us in advance of any waste that may be hazardous, dangerous, explosive, flammable, toxic, corrosive, infectious or otherwise subject to special handling requirements. Examples may include but are not limited to chemicals, solvents, paints, oils, asbestos, clinical waste, gas cylinders, batteries and electrical equipment containing hazardous components.

7.4 We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous or prohibited, or for which you have not provided prior notice and obtained our written agreement.

7.5 Where we agree to collect hazardous or regulated materials, you must comply with any instructions we give regarding packaging, labelling, segregation or storage prior to collection.

7.6 You confirm that you have the authority to present the waste for collection and that its removal will not breach any lease, licence, planning consent, environmental permit, local by-law or other legal obligation.

8. Customer Warranties and Indemnities

8.1 You warrant that:

a. The information you provide to us about the waste and the collection location is accurate and complete.

b. The waste does not contain any items that are prohibited or unlawful for us to transport or dispose of.

c. Access to the collection point is safe and suitable for our staff and vehicles.

8.2 You agree to indemnify us against any losses, costs, claims, damages, penalties or expenses we suffer arising from:

a. Your breach of these Terms and Conditions.

b. Your failure to disclose hazardous or prohibited materials within the waste.

c. Any damage or injury caused by unsafe access conditions that you knew or ought reasonably to have known about and did not disclose.

9. Our Liability

9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

9.2 Subject to paragraph 9.1, we shall not be liable for:

a. Loss of profits, loss of business, loss of revenue or loss of anticipated savings.

b. Loss of or damage to goodwill or reputation.

c. Indirect, special or consequential loss or damage.

9.3 We will exercise reasonable care and skill when providing the Service. If we damage your property as a result of our negligence, you must notify us as soon as reasonably practicable and in any event within a reasonable time of becoming aware of the damage. Our liability for such damage shall be limited to the reasonable cost of repair or, where appropriate, replacement.

9.4 You are responsible for ensuring that items not intended for removal are clearly separated from waste. We shall not be liable for the removal of items where, acting reasonably, we believed them to be waste due to their placement or your instructions, unless the removal was due to our clear error and you notify us promptly.

9.5 Our total liability to you in respect of all losses arising under or in connection with the Contract, whether in contract, tort, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by you for the specific Service giving rise to the claim.

10. Insurance

10.1 We maintain insurance cover that we consider appropriate for the nature of our waste disposal operations, including public liability insurance, subject to policy terms and exclusions.

10.2 Details of our insurance may be made available to you upon reasonable request.

11. Complaints

11.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible so that we have an opportunity to investigate and, where appropriate, remedy the issue.

11.2 We may ask you to provide supporting information or evidence relating to your complaint. We will handle complaints fairly and aim to respond within a reasonable time.

12. Data Protection and Privacy

12.1 We collect and process personal data in order to manage bookings, provide the Service, handle payments and communications, and comply with legal obligations.

12.2 We will handle your personal data in accordance with applicable UK data protection laws. We will take reasonable steps to keep your personal data secure and to prevent unauthorised access, use or disclosure.

12.3 By using our Service, you consent to the collection and use of your personal data for the purposes described in these Terms and Conditions and any additional notices we provide at the time of collection.

13. Force Majeure

13.1 We shall not be in breach of the Contract or otherwise liable for any delay in or failure to perform the Service as a result of events, circumstances or causes beyond our reasonable control. These may include but are not limited to severe weather, fires, floods, strikes, lockouts, industrial disputes, traffic incidents, road closures, civil unrest, acts of terrorism, war, pandemics and government restrictions.

13.2 Where a force majeure event occurs, we will use reasonable endeavours to notify you and, where possible, to reschedule the Service once the event has passed or its impact reduced.

14. Variation

14.1 We may amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking, unless a change is required by law or regulatory authority, in which case it may apply retrospectively to existing Contracts.

14.2 Any changes to the details of the Service agreed with you will be effective only if confirmed by us.

15. Severability

15.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision or part-provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

17. Entire Agreement

17.1 These Terms and Conditions, together with any booking confirmation or written variation agreed between us, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings, arrangements or representations, whether oral or written.

17.2 You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these Terms and Conditions or in the booking confirmation.
